THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.

Our Commitment to Your Privacy

Turned Leaf Psychiatry LLC ("we," "us," or "our") is required by law to protect the privacy of your protected health information ("PHI"). PHI is information that identifies you and relates to your past, present, or future physical or mental health, the care you receive, or payment for that care.

We are required by law to:

Maintain the privacy and security of your PHI;

Give you this Notice of our legal duties and privacy practices;

Follow the terms of the Notice currently in effect; and

Notify you promptly if a breach occurs that may have compromised the privacy or security of your PHI.

This Notice applies to all records of your care created or received by Turned Leaf Psychiatry, whether you are seen in person or by telehealth, and applies to all of our clinicians and staff.

How We May Use and Disclose Your Health Information

We may use and disclose your PHI without your written authorization for the following purposes.

Treatment

We use and share your PHI to provide, coordinate, and manage your care. For example, your psychiatric clinician may send a prescription to your pharmacy, consult with your primary care provider, or share information with a therapist or hospital involved in your care.

Payment

We use and share your PHI to bill and receive payment for your care. For example, we may give your health plan information about your diagnosis and the services you received so that it will pay us, or to obtain prior authorization for a medication.

Health Care Operations

We use and share your PHI to run our practice and improve the quality of care. For example, we may review records to evaluate our clinicians' performance, train staff and students, conduct billing audits, or work with business associates (such as our electronic health record, billing, and IT vendors) who sign agreements requiring them to protect your information.

Appointment Reminders and Communications

We may contact you by phone, text message, email, or through our secure patient portal to remind you of appointments or to share information about your care or billing. You may ask us to contact you in a different way (see "Your Rights" below).

Other Uses and Disclosures Permitted or Required by Law

We may also use or share your PHI without your authorization in the following situations, as allowed or required by federal and Mississippi law:

As required by law: When federal, state, or local law requires it.

Serious threat to health or safety: To prevent or lessen a serious and imminent threat to your health or safety or that of another person or the public.

Abuse, neglect, or domestic violence: To report suspected abuse or neglect of a child or vulnerable adult to the appropriate authorities, as required by Mississippi law.

Public health activities: To report diseases, adverse reactions to medications, or product problems, or to help with product recalls.

Health oversight: To agencies that oversee the health care system, such as for audits, investigations, inspections, and licensing.

Lawsuits and legal proceedings: In response to a court or administrative order, or in response to a subpoena or other lawful request when the law allows.

Law enforcement: To law enforcement officials in limited circumstances allowed by law.

Coroners, medical examiners, and funeral directors: As needed for them to carry out their duties.

Organ and tissue donation: To organizations that handle organ, eye, or tissue donation.

Research: For research approved under privacy protections required by law.

Specialized government functions: For military, national security, or protective services, as authorized by law.

Workers' compensation: As authorized by workers' compensation laws.

Prescription drug monitoring: To report controlled substance prescriptions to the Mississippi Prescription Monitoring Program, as required by law.

Family Members and Others Involved in Your Care

Unless you object, we may share information directly relevant to your care or payment with a family member, friend, or other person you identify as involved in your care. If you are not present or are unable to agree or object, we may use professional judgment to decide whether sharing is in your best interest. We may also use or share your PHI to notify someone responsible for your care of your location or general condition, including in an emergency.

Uses and Disclosures That Require Your Written Authorization

We will not use or share your PHI for the following purposes unless you give us written permission:

Psychotherapy notes: Most uses and disclosures of psychotherapy notes (a clinician's separate notes analyzing the contents of counseling sessions), except as permitted by law.

Marketing: Uses and disclosures for marketing purposes.

Sale of PHI: We will never sell your PHI.

Any other use or disclosure not described in this Notice will be made only with your written authorization. You may revoke an authorization in writing at any time, except to the extent we have already acted on it.

Substance Use Disorder Treatment Records

If we receive or maintain records about you from a substance use disorder treatment program that is protected under federal law (42 C.F.R. Part 2), those records have additional protections. We will not use or disclose those records, or testimony describing their contents, in any civil, criminal, administrative, or legislative proceeding against you unless you give written consent or a court issues an order after giving you notice and an opportunity to be heard, as required by law.

Your Rights Regarding Your Health Information

You have the following rights. To exercise any of them, please contact our Privacy Officer using the information at the end of this Notice. Some requests must be made in writing.

Right to see and get a copy of your records: You may ask to see or get an electronic or paper copy of your medical and billing records. We will respond within 30 days and may charge a reasonable, cost-based fee. In limited cases we may deny access, and you may ask for the denial to be reviewed.

Right to ask us to correct your records: If you believe information in your record is incorrect or incomplete, you may ask us in writing to amend it. We may say no, but we will tell you why in writing within 60 days.

Right to request confidential communications: You may ask us to contact you in a specific way (for example, only by cell phone) or at a different address. We will agree to all reasonable requests.

Right to request restrictions: You may ask us to limit how we use or share your PHI for treatment, payment, or operations. We are not required to agree, except in one case: if you pay for a service or item out of pocket in full, you may ask us not to share information about it with your health plan, and we will agree unless the law requires us to share it.

Right to an accounting of disclosures: You may ask for a list of the times we shared your PHI in the six years before your request, who we shared it with, and why. The list will not include disclosures for treatment, payment, or operations, or disclosures you authorized. We provide one free list every 12 months.

Right to a paper copy of this Notice: You may ask for a paper copy of this Notice at any time, even if you agreed to receive it electronically.

Right to choose someone to act for you: If you have given someone medical power of attorney, or if someone is your legal guardian, that person can exercise your rights. We will confirm the person has this authority before we take any action.

Right to be notified of a breach: You have the right to be notified if your unsecured PHI is affected by a breach.

Minors

In most cases, a parent or legal guardian may exercise the rights described in this Notice on behalf of a minor patient. Where Mississippi or federal law allows a minor to consent to their own care, the minor may control certain information about that care.

Changes to This Notice

We reserve the right to change this Notice and to make the new Notice apply to all PHI we maintain, including information created or received before the change. The current Notice will be posted in our office and on our website, and a copy will be available on request.

Complaints

If you believe your privacy rights have been violated, you may file a complaint with us by contacting our Privacy Officer. You may also file a complaint with the U.S. Department of Health and Human Services, Office for Civil Rights, by writing to 200 Independence Avenue S.W., Washington, D.C. 20201, calling 1-877-696-6775, or visiting www.hhs.gov/ocr/privacy/hipaa/complaints/. We will not retaliate against you for filing a complaint.
